PeekDesk Terms of Service

Table of Contents
§ 1 Definitions
The terms used in these Terms of Service shall have the following meanings:
- Service Provider — Life Automation Przemysław Wywigacz, ul. Morska 6C/18, 84-240 Reda, NIP: 7422089612, REGON: 363795969, e-mail: hello@peekdesk.com.
- Platform — the PeekDesk web application available at peekdesk.com, including all of its functionalities.
- User — any natural person, legal entity, or organizational unit without legal personality using the Platform.
- Consumer — a User who is a natural person entering into a legal transaction not directly related to their business or professional activity (Article 221 of the Polish Civil Code), as well as a sole proprietor for whom the contract is not of a professional nature (Article 3855 of the Polish Civil Code).
- Co-browsing Session — a single real-time connection between two or more Users enabling the sharing of a webpage view (DOM) in a browser.
- Free Plan — a free-of-charge access plan for the Platform with the limitations described in § 3.
- Pro Plan — a paid access plan for the Platform available in monthly or annual variants, with full functionality.
- Account — a collection of resources and settings assigned to a User, created as a result of registration on the Platform.
- Terms — this document setting out the rules for using the Platform.
- GDPR — Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data.
§ 2 General Provisions
- These Terms set out the rules for the provision of electronic services by the Service Provider through the Platform, in accordance with the Polish Act of 18 July 2002 on the Provision of Electronic Services.
- The Service Provider is: Life Automation Przemysław Wywigacz, ul. Morska 6C/18, 84-240 Reda, NIP: 7422089612, REGON: 363795969.
- Contact with the Service Provider: e-mail hello@peekdesk.com.
- Use of the Platform constitutes acceptance of these Terms. A User who does not accept these Terms should cease using the Platform.
- These Terms are made available free of charge in a form that allows them to be stored and reproduced.
§ 3 Types and Scope of Services
- The Platform enables co-browsing sessions, i.e., real-time sharing of a webpage view with other Users.
- The Service Provider offers the following plans:
- Free Plan — free of charge; sessions limited to 2 minutes; maximum 10 sessions per day.
- Pro Monthly Plan — $29 USD net per month (+ VAT at the applicable rate); unlimited session duration and number of sessions.
- Pro Annual Plan — $228 USD net per year (+ VAT at the applicable rate); unlimited session duration and number of sessions.
- The Service Provider reserves the right to introduce additional plans or modify the scope of existing ones, in accordance with the procedure set out in § 12.
- A detailed description of the features of each plan is available on the Platform website.
§ 4 Technical Requirements
The following are required to use the Platform:
- A device with Internet access.
- A current version of a web browser supporting JavaScript, WebSocket, and the ES2020+ standard (e.g., Google Chrome, Mozilla Firefox, Microsoft Edge, Safari).
- Cookies and localStorage enabled in the browser.
- A valid e-mail address — required for registration and login.
The Service Provider shall not be liable for technical issues arising from failure to meet the above requirements.
§ 5 Rules of Use
- The User undertakes to use the Platform in accordance with its intended purpose, these Terms, and applicable law.
- The User is responsible for maintaining the confidentiality of their Account login credentials.
- It is prohibited to share an Account with third parties or to use Accounts belonging to other Users without their consent.
- The User bears sole responsibility for any content shared during co-browsing sessions.
- It is prohibited to undertake any actions that may disrupt the proper functioning of the Platform, including attempts to gain unauthorized access to the Platform's resources.
- The Service Provider reserves the right to suspend or delete the Account of a User who violates these Terms.
§ 6 Prohibited Content
- The User undertakes not to share any unlawful content through the Platform, including but not limited to:
- content infringing copyrights, trademarks, or other intellectual property rights of third parties;
- pornographic, racist, xenophobic content, or content inciting violence;
- spam, phishing, or other forms of fraud;
- malicious software or code that may compromise the security of information systems;
- content violating the personal rights or privacy of third parties.
- If unlawful content is found to have been shared, the Service Provider has the right to immediately block access to the Platform and delete the User's Account.
- Users may report unlawful content to: hello@peekdesk.com. The Service Provider shall review such reports within 14 days.
§ 7 Personal Data Protection
- The controller of Users' personal data is the Service Provider.
- Personal data is processed in accordance with the GDPR and the Polish Act of 10 May 2018 on the Protection of Personal Data.
- Detailed information regarding the processing of personal data, including purposes, legal bases, data categories, data subject rights, and retention periods, is contained in the Privacy Policy available at /privacy.
- Providing personal data is voluntary but necessary to use the Platform insofar as Account registration is required.
§ 8 Plans and Payments
- Use of the Free Plan does not require the provision of payment details.
- Payments for the Pro Plan are processed through the payment operator Stripe. The Service Provider does not store Users' payment card data.
- Prices listed on the Platform are net prices. VAT is added at the applicable rate (currently 23%).
- The Pro Monthly Plan subscription renews automatically for the next billing period unless the User cancels the subscription before the end of the current period.
- The Pro Annual Plan subscription renews automatically for the next year unless the User cancels the subscription at least 7 days before the end of the annual period.
- The Service Provider issues VAT invoices in electronic form. Invoices are made available in the User's Account panel.
- In the event of non-payment, the Service Provider has the right to downgrade the User's access to the Free Plan.
§ 9 Liability and Limitations
- The Service Provider makes every effort to ensure uninterrupted and proper operation of the Platform; however, it does not guarantee 24/7 availability.
- The Service Provider shall not be liable for:
- interruptions in the operation of the Platform resulting from technical causes, maintenance, or force majeure;
- content shared by Users during co-browsing sessions;
- loss of data caused by the actions of the User or third parties;
- damages resulting from the User's failure to meet the technical requirements.
- For Users who are not Consumers, the Service Provider's liability shall be limited to the total fees paid by the User during the preceding 12 months.
- The above limitations of liability shall not apply to damages caused intentionally.
§ 10 Complaints
- The User has the right to file a complaint regarding the operation of the Platform.
- Complaints should be sent to the e-mail address: hello@peekdesk.com, including:
- the User's identification data (first name, last name or company name, e-mail address associated with the Account);
- a description of the issue forming the basis of the complaint;
- the expected resolution.
- The Service Provider shall review the complaint within 14 days from the date of its receipt and shall inform the User of the outcome by electronic means.
- Consumers may use out-of-court complaint and redress mechanisms, including through the EU ODR platform: ec.europa.eu/consumers/odr.
§ 11 Right of Withdrawal
- A Consumer who has entered into a distance contract has the right to withdraw from it without giving any reason within 14 days from the date of conclusion of the contract, in accordance with the Polish Act of 30 May 2014 on Consumer Rights.
- The withdrawal statement should be sent to the e-mail address: hello@peekdesk.com or in writing to the Service Provider's registered address.
- In the event of withdrawal from the contract, the Service Provider shall refund all payments received from the Consumer without undue delay, and no later than within 14 days from the date of receipt of the withdrawal statement.
- The refund shall be made using the same method of payment as used by the Consumer, unless the Consumer has expressly agreed to a different method of refund.
- The right of withdrawal shall not apply where the Service Provider has fully performed the service with the Consumer's express and prior consent, and the Consumer was informed before the commencement of the service that, upon its completion, the right of withdrawal would be forfeited (Article 38(1) of the Polish Consumer Rights Act).
§ 12 Amendments to the Terms
- The Service Provider reserves the right to amend these Terms for important reasons, including but not limited to:
- changes in legislation affecting the services provided;
- changes in the scope or manner of service provision;
- the need to adapt these Terms to recommendations, decisions, or rulings of public administration bodies or courts.
- The Service Provider shall notify Users of any planned amendments to these Terms at least 14 days before the changes take effect, by sending a notification to the e-mail address associated with the Account.
- A User who does not accept the amendments to these Terms has the right to terminate the agreement (delete the Account) before the date on which the changes take effect. Failure to terminate the agreement before that date shall constitute acceptance of the amended Terms.
§ 13 Governing Law
- These Terms and any agreements entered into on the basis thereof shall be governed by the laws of Poland.
- In matters not regulated by these Terms, the provisions of the Polish Civil Code, the Act on the Provision of Electronic Services, the Consumer Rights Act, and the GDPR shall apply.
- Any disputes between the Service Provider and a User who is not a Consumer shall be resolved by the court having jurisdiction over the Service Provider's registered office.
- Disputes involving Consumers shall be resolved by the court having jurisdiction in accordance with the provisions of the Polish Code of Civil Procedure.
§ 14 Final Provisions
- These Terms shall enter into force on February 25, 2026.
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- These Terms have been drawn up in the English language. In the event of any discrepancy between language versions, the English version shall prevail.
- The Service Provider reserves the right to temporarily suspend the operation of the Platform for the purpose of maintenance or updates, and shall notify Users with reasonable advance notice where possible.
